In January 2025, Lady Liberty Australia - Kate Fantinel, launched a Legal Action campaign against Western Australia's new gun laws, funded only by the People, for the People.
Forming a coalition with Ben Dickens from Carter Dickens Lawyers and engaging a preeminent Western Australian King's Counsel, Jason MacLaurin SC, Lady Liberty Australia successfully raised enough funds to obtain the expert legal advice on the legalities of the laws: just in time for the March 2025 State Election.
No shooting organisation had engaged with the judiciary to seek their help and guidance for their members, despite staring down the barrel of the most restrictive gun laws ever seen in Australia.
Denying requests for urgent assistance, no shooting organisation donated to the campaign. All donations have come from the People, who have suffered throughout the entire Firearms Reform process.
The State Labor Government and former Police Minister, Paul Papalia MLA, announced its new anti-gun Firearms Regime in March 2022, by doxxing WA gun owners using private information contained in the Firearms Registry.
A map printed on the front page of the West Australian newspaper identified where lawful firearm owners lived, putting both public and private safety at risk.
What followed was a relentless attack on private property rights, disregard for liberties and disrespect for gun owners by the State Labor Government, with the complicit media participating in the dangerous doxxing stunt and fueling the fear campaign.
After three years of disingenuous consultation from the Minister and failed lobbying and media attempts by the shooting organisations, the State Labor Government used its absolute majority to pass its oppressive Firearms Regime.
This included severely limiting the number of firearms a person can own; expanding the fit and proper persons test to include mandatory medical assessments; restricting the number of hunters on private land; increasing storage requirements beyond proportional rates; and banning firearm types and calibres.
The list of grievances goes on and continues to grow, with legal advice obtained showing multiple potential avenues to challenge the laws.
While considering a run for office in the 2025 State Election, with her 2022 Senate result all but guaranteeing electoral success, Lady Liberty Australia listened to the needs of the People and started the Legal Action campaign instead.
Immediately following the State Election, funds were used to serve legal letters to the Police Commissioner and the new Police Minister, Reece Whitby MLA, alerting him to potential legal challenges to the State's compensation scheme.
Many firearm owners suddenly found themselves in possession of imminently illegal guns when the State banned push-button release firearms and lever-action firearms above five rounds on the cusp of Christmas, 2024. The compensation scheme had already ended.
Despite the rip-off prices offered by State, which form part of the urgent legal advice obtained through this campaign, many gun owners stood to receive no compensation for their private property.
The restrictive new gun laws had already interfered in the market, with prices crashing and excessive transportation costs not a viable option.
The compensation scheme was re-opened shortly after our letter was served, with challenges to the prices still pending.
This paved the way for political change, with the new WA Parliament agreeing to send the gun laws to a review. This again saw more legal action taken, with a letter served calling for a ceasefire any precipitous action against gun owners while the review is in effect.
Another urgent legal letter was sent to the Police Minister and Police Commissioner regarding the unjust compensation scheme, challenging the justification for the prices paid by the State to people who handed in their private property at a substantial loss.
The legal campaign has also put pressure on the State for its destruction program, with firearm owners horrified to see their surrendered firearms blown up using explosives at an undisclosed location on September 11, 2024. Our letters call for a cease on the destruction of any current surrendered firearms, including questions around the new operational procedures of the Western Australian Police Force.
Urgent legal advice was sought through the campaign following revelations of the WA Firearms Portal security breach in July 2025. Firearm owners were once again put in the position where private information has been put at risk, with the new system proving unworkable.
The WA Legal Action campaign remains ongoing and has attracted overwhelming support from around Australia and the United States. With Lady Liberty Australia as the Client representing the People, the Western Australian Government has been forced to reconsider its Regime.
A note from Kate in response to the MEDIA:
This campaign continues to be funded by your donations, with all funds solely used to fund the work required to continue Legal Action against Western Australia's gun laws.
I started this campaign from my dad’s gun room in South Australia and will continue to lead this campaign wherever I am in the world. My current home in the Free State of Texas has only fueled my passion to fight for Australian gun owners: living in a State where my God-given right is enshrined in Law is how I view a society should be.
This is what makes me get out of bed every day and continue to do the work with my coalition and People back home in Western Australia. I am still a proud Western Australian and Australian citizen who wants to use my platform to fight for my community.
Any attempt to present me as untrustworthy is a reflection on the culture of the establishment and old guard who have presided over the greatest loss of our freedoms since 1996. The attacks on my character and intentions have only sought to create division and sow seeds of distrust while damaging my reputation and career .
I have always said that my motivation to fight for Australian gun owners comes from witnessing the injustices my father suffered in 1996. As a proud shooter, former Australian gun owner and country girl, it has been shocking to witness – firsthand, across the country! - the loss of more liberties, more government overreach, and more failure from our organisations.
If Western Australia falls, the entire shooting and hunting community is at stake. We must fight back.
Despite the personal and professional damage this campaign has caused me, my work will continue for as long as it can. You must be prepared to be crucified when you fight for gun rights in Australia, and I cannot do this alone.
Thank you for your support.
Yours in liberty,
Kate Fantinel - Lady Liberty
